Stopping the Soderberghicon

Yesterday, we received some unfortunate news here at Lucky Dog Audio in the form of a cease and desist letter.

Exhibit A: The Letter

An attorney representing Steven Soderbergh claims that our use of the term "Soderberghicon" violates copyright law. And I quote:

Dear Scott Minor:

It has come to my attention that you have made an unauthorized use of the
copyrighted name “Steven Soderbergh” in the preparation of a work derived
therefrom. Mr. Soderberg has reserved all rights in his Name, first
published on January 14th, 1963, and has registered copyright therein.
Your work entitled "Soderberghicon" is in parts identical to this Name and
clearly uses the Name as its basis.

As you neither asked for nor received permission to use the Name as the
basis for the “Soderberghicon” nor to make or distribute copies, including
electronic copies, of same, I believe you have willfully infringed Mr.
Soderbergh's rights under 17 U.S.C. Section 101 et seq. and could be
liable for statutory damages as high as $150,000 as set forth in Section
    504(c)(2) therein.

I demand that you immediately cease the use and distribution of all
infringing works derived from the Name, and all copies, including
electronic copies, of same, that you deliver to me, if applicable, all
unused, undistributed copies of same, or destroy such copies immediately
and that you desist from this or any other infringement of his rights in
the future. If I have not received an affirmative response from you by
April 14, 2008 indicating that you have fully complied with these
requirements, I shall take further action against you.

This letter is a painful slap on the wrist for us here at Lucky Dog Audio.

Exhibit B: The Painful Slap On The Wrist

We never intended any malfeasance with our Soderberghicon. We created it to pay tribute to one of our favorite directors, who also just so happens to resemble in some parts our very own Scott Minor. Just take a gander at the photo below, taken of Scott and Steven last year, backstage at MSNBC.

Exhibit C: The Resemblance

Uncanny! Is it not?

Obviously, we don't want to stir up any trouble (or pay $150,000!). Therefore we have renamed the "Soderberghicon" the "Sminoricon" and have replaced Steven's picture with one of Scott, like so:

Exhibit D: The Soderberghicon (Before)

Exhibit E: The Sminoricon (After)

Whew! Disaster averted.

Charles Simic's Lucky Day

Today, one of my favorite poets, Charles Simic, received a double dose of good fortune as he was named poet laureate of the United States and was awarded $100,000 from the American Academy of Poets.

"Now I just have to break a leg. It's just too much luck,'' he said in a telephone interview. "I'm just overwhelmed by the amount of good luck, being a superstitious person.''

via Bloomberg.

Ironically enough, my favorite book of Simic's is entitled (unluckily) Walking the Black Cat.

Read This

Part 1: Vulture, New York magazine's Arts and Entertainment blog, has this cool section called the "Weekend Read." They post an article in pdf format for you to print out, take home, and read at your leisure.

Part 2: So a friend of a friend has this intriguing experience with a landlord. The first friend encourages his friend (the friend of the friend) to write about the experience. After several years, the friend of the friend finally writes the story. It turns out that the friend of the friend writes really well. In the fall of 2006, his story gets published in the Georgia Review.

Part 3: The National Magazine Awards come around every spring. This year, up against big name essayists like Calvin Trillin and Paul Theroux rises an underdog writer named Michael Donahue. Donahue's first published article appeared in the Fall/Winter 2006 issue of the Georgia Review. It's entitled "Russell and Mary."

Part 4: On May 1st, "Russell and Mary" wins the Essay category of the 2007 National Magazine Awards.

This category recognizes excellence in essay writing on topics ranging from the personal to the political. Whatever the subject, it honors the author’s eloquence, perspective, fresh thinking and unique voice.

Part 5: Last Friday New York magazine posted this great story by Michael Donahue in their "Weekend Read" section. . .

Friends On Oprah

Though she's primarily famous (around these parts) for this commissioned portrait of a certain dashing mutt named "Lucky," our buddy, former collegiate school-mate, and super-talented designer/photographer/painter Jane Mount turned up on Oprah yesterday in a profile about home makeovers. To see what Jane did to her 645 square foot apartment that got Oprah's attention, go to Where The Wild Things Are. This online article includes pictures and a description of what went into Jane's fifth floor tenement apartment makeover as well as praise for the inventive and creative work Jane and her boyfriend Darko did to turn their tight living quarters into a stylish and utilitarian home. Once you are finished peeking around her apartment, make sure you check out Jane's art work, photography, and web design at jane mount.
